MMELEMENT / MME Car Intel is an AI-powered car buying intelligence platform that provides the following tools and services:

• Deal Analyzer — analyzes used car listings to produce a deal score, fair market value estimate, and negotiation anchor based on market comparables.
• Red Flag Scanner — inspects vehicle photos using AI to identify potential issues across multiple categories including body damage, mechanical concerns, and cosmetic defects.
• VIN Decoder — decodes Vehicle Identification Numbers using NHTSA data to retrieve comprehensive vehicle specifications, manufacturing details, and safety information.
• AI Car Buying Assistant (Chatbot) — an AI-powered conversational assistant that provides real-time vehicle intelligence, recall lookups, reliability assessments, market value estimates, and negotiation strategies.
• Negotiation Script Generator — generates personalized negotiation playbooks with opening offers, counter-offer strategies, talking points, and walk-away thresholds based on vehicle data and market analysis.
• Ownership Cost Predictor — estimates total cost of ownership over a defined period including depreciation, insurance, maintenance, and fuel costs.
• Vehicle Comparison — side-by-side comparison of multiple vehicles across key metrics.
• Community Wisdom — aggregated insights and owner experiences from the MMELEMENT user community.
• Blog — editorial content on car buying strategy, market trends, and tips at mmelement.blog.

All reports, scripts, and outputs generated by the Service are informational only and are not a substitute for a professional pre-purchase inspection, certified appraisal, or legal, financial, or mechanical advice. Negotiation scripts are suggestions based on algorithmic analysis and should be adapted to your specific situation.

3. User Accounts

Certain features of the Service may require you to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at [email protected].

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

• Use the Service to generate reports or negotiation scripts for commercial resale without a separate written agreement with MMELEMENT.
• Submit fraudulent VIN numbers, vehicle data, or listing information to manipulate analysis results.
• Use AI-generated negotiation scripts to engage in deceptive or fraudulent purchasing practices.

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, AI models, algorithms, negotiation frameworks, and software — are the exclusive property of MMELEMENT Automotive Intelligence, LLC (d/b/a MME Car Intel) and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. User-Submitted Content

When you submit content to the Service (such as vehicle photos, listing URLs, VIN numbers, or community posts), you grant MMELEMENT a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content solely for the purpose of operating and improving the Service. You represent that you have all necessary rights to submit such content. Vehicle data submitted for analysis may be processed through third-party APIs (such as NHTSA and OpenAI) as described in our Privacy Policy.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence, including large language models, to generate deal analyses, negotiation scripts, vehicle assessments, and chatbot responses. AI-generated content may contain inaccuracies, outdated information, or errors. You acknowledge and agree that:

• AI-generated negotiation scripts are suggestions only and should not be relied upon as professional negotiation, legal, or financial advice.
• Market value estimates are algorithmic approximations and may not reflect actual transaction prices in your area.
• Vehicle condition assessments based on photos are not a substitute for a professional mechanical inspection.
• You are solely responsible for any decisions made based on information provided by the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AI-GENERATED REPORTS, NEGOTIATION SCRIPTS, AND CHATBOT RESPONSES MAY CONTAIN INACCURACIES AND SHOULD NOT BE SOLELY RELIED UPON FOR PURCHASING DECISIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MMELEMENT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO RELIANCE ON AI-GENERATED NEGOTIATION SCRIPTS, DEAL ANALYSES, OR VEHICLE ASSESSMENTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless MMELEMENT and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, your use of AI-generated negotiation scripts in vehicle transactions, or your infringement of any third-party rights.

11. Third-Party Links and Services

The Service integrates with and relies upon third-party services and APIs, including but not limited to the National Highway Traffic Safety Administration (NHTSA) API for vehicle data and recalls, and OpenAI API for AI-powered analysis and chatbot functionality. The Service may also contain links to third-party websites, including car listing platforms and data providers. These integrations and links are provided for functionality and convenience. MMELEMENT has no control over the content, accuracy, or practices of third-party services and assumes no responsibility for them.

12. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We may also update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
